  1. These general terms and conditions apply to every offer made by JUUNIEK and to every contract concluded between JUUNIEK and the customer, including distance contracts (online sales).
  2. Before being able to proceed with ordering a product, the customer must always first read the general terms and conditions and expressly confirm that they accept these general terms and conditions, failing which the order cannot be completed. Every order placed by the customer therefore constitutes acceptance of these general terms and conditions, which form an integral part of the contract, to the exclusion of the customer’s own general terms and conditions.
  3. The invalidity of these terms and conditions or of any of the clauses of these terms and conditions set out below shall not affect the validity of the contract and the other clauses. In such a case, the disputed clause shall be replaced by mutual agreement with an enforceable and legally valid provision that corresponds as closely as possible to the purpose of the original clause.

Art. 3 – Offer

  1. The offer of JUUNIEK contains as complete and accurate a description as possible of the products offered. The description is sufficiently detailed to allow a proper assessment of the product.
  2. All images, photos, drawings, information regarding weight, dimensions, colour, images of labels, … on the JUUNIEK website are, however, only approximate, indicative and not binding. Colours may deviate from reality to a certain extent. Any deviations cannot give rise to compensation or termination of the contract.
  3. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
  4. The products included in an offer are intended exclusively for normal private use.
  5. Every offer is valid only while stocks last.

Art. 4 – Order – contract

  1. To be able to place an order or make a purchase, the customer must be at least 18 years old.
  2. JUUNIEK is always entitled to refuse an order in the following cases:
    1. if the customer turns out to be a minor;
    2. if a manifest mistake or a manifest error was made in the offer;
    3. if the delivery address is not located in Belgium or the Netherlands;
    4. if the stock of a particular item is exhausted;
    5. in the event of force majeure, bad faith or abuse of rights;
    6. if no payment has been received;
  3. Subject to paragraph 2, the contract is concluded at the moment the customer places an order and thereby accepts the offer.
  4. If the customer has accepted the offer electronically, JUUNIEK will confirm receipt of the acceptance of the offer electronically without delay.

Art. 5 – Agreed price

  1. All prices stated are always expressed in euros and include all taxes, VAT and levies, and exclude shipping costs.
  2. The amount of the delivery and shipping costs is indicated on the website and in any case clearly stated before the order is final.
  3. Different discount codes can never be combined.

Art. 6 – Payment

  1. A purchase is only final upon receipt of payment.
  2. For payment by credit or debit card, JUUNIEK must have received the approval of the card issuer. If the card issuer refuses to authorise the payment to JUUNIEK, JUUNIEK is not responsible for delays in delivery and/or non-delivery of the order.
  3. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
  4. To guarantee secure online payment and the security of the customer’s personal data, the transaction data are encrypted.
  5. For online purchases, JUUNIEK accepts the following means of payment: Bancontact, iDEAL and other electronic means of payment indicated on the website.

Art. 7 – Delivery

  1. Delivery takes place at the earliest after receipt of full payment.
  2. After receipt of full payment, the ordered products will be delivered within the period indicated at the time of ordering. The delivery periods indicated are for guidance only.
  3. The products are delivered to the address provided by the customer when placing the order. Incorrectly provided addresses are the sole responsibility of the customer and may give rise to additional costs.
  4. Unless otherwise stated, deliveries are carried out by PostNL and may be made at home, at a post point or at a PostNL parcel locker.
  5. JUUNIEK is not responsible for late delivery or non-delivery by its logistics partner.

Art. 8 – Custom-made and digital products

  1. Orders for custom-made products can only be cancelled if JUUNIEK has not yet started making the products.
  2. Products that are made or ordered specifically to the customer’s specifications cannot be exchanged or taken back by JUUNIEK. The right of withdrawal as set out in article 9 of these general terms and conditions does not apply to products specifically made and ordered to measure.

Art. 9 – Right of withdrawal (cooling-off period) for distance sales

  1. The provisions of this article apply only to customers who purchase items online in their capacity as consumers.
  2. The customer has the right, within 14 calendar days of receipt of the product, to withdraw from the contract relating to the distance purchase of a product without giving any reason and without paying a penalty, in accordance with the terms and conditions set out below.
  3. The period of 14 calendar days referred to in paragraph 2 begins:
    1. either on the day after the customer, or a third party designated in advance by the customer other than the carrier, has received the product;
    2. or, in the case of multiple products or products consisting of several shipments or parts that form part of a single order but are delivered separately, on the day after the customer, or a third party designated in advance by the customer other than the carrier, has received the last product, the last shipment or the last part;
    3. or, in the case of regular delivery over a certain period, on the day after the customer or a third party designated in advance by the customer other than the carrier has received the first product.
  4. The customer informs JUUNIEK of their decision to withdraw from the contract before the expiry of the withdrawal period of 14 calendar days by:
    1. either sending JUUNIEK an unequivocal statement clearly setting out the decision to withdraw from the contract;
    2. no later than 14 calendar days after notifying JUUNIEK of the withdrawal, the customer returns the products or hands them over to JUUNIEK or to a person authorised by JUUNIEK to receive the products.
  5. The customer returns the products with all accessories supplied, if reasonably possible in their original condition and packaging.
  6. The customer bears the direct costs of returning the products.
    1. The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lie with the customer.
    2. During the cooling-off period, the customer undertakes to handle the product and its packaging with care. The customer also undertakes to unpack or use the product only to the extent necessary to establish the nature, characteristics and functioning of the product, the starting principle being that the customer may only handle and inspect the product as they would be allowed to in a shop.
    3. The customer is liable for any diminished value of the product resulting from handling the product beyond what is necessary to establish that the product works properly.
    4. Within 14 days of notifying JUUNIEK of the withdrawal, and provided that the customer has actually sent back the products (or at least provides proof of return) or returned them to JUUNIEK, the full purchase price of the products will be refunded using the same means of payment that the customer used to pay for the order.
    5. The customer is not entitled to invoke their right of withdrawal in the following cases:
      1. the price of the products or services is subject to fluctuations in the financial market over which JUUNIEK has no control and which may occur within the withdrawal period;
      2. the goods supplied are made specifically to measure for the customer, manufactured according to the customer’s specifications or clearly intended for a specific person;
      3. the goods supplied are liable to deteriorate or have a limited shelf life;
      4. the sealed goods have been opened after delivery and cannot be returned for reasons of health protection or hygiene;
      5. the goods supplied have, after delivery, become inseparably mixed with other products;
      6. the goods supplied are alcoholic beverages the price of which was agreed upon at the conclusion of the sales contract but the delivery of which can only take place after 30 days, and the actual value of which depends on market fluctuations over which JUUNIEK has no control;
      7. digital products
      8. foodstuffs
      9. the contract was concluded at a public auction;

Art. 10 – Inspection, complaints and warranty

  1. JUUNIEK guarantees the conformity of the products it offers as provided for in the statutory consumer guarantee.
  2. JUUNIEK works with a natural material, namely wood. All natural materials have their own unique character (colour, shape, shading), which means that the end result will always be unique.
  3. The customer undertakes to take receipt of the goods supplied immediately upon delivery and to examine whether their quality corresponds to what was agreed.
  4. The customer must notify JUUNIEK in writing of any lack of conformity within a period of two months of discovering it. If JUUNIEK is not notified of the lack of conformity within two months of its discovery, the customer loses their right to bring a claim against JUUNIEK on the grounds of lack of conformity.
  5. In the event of a lack of conformity, the customer is entitled to repair or replacement of the product within a reasonable period.
  6. The warranty granted lapses in the event of abnormal use, poor maintenance, use contrary to the manufacturer’s instructions, modification of goods by the customer, disassembly or repair by an unqualified person, damage resulting from fire, water damage, lightning, accidents, natural disasters, intent, negligence or improper handling.

Art. 11 – Liability

  1. JUUNIEK is not liable for typing errors submitted by the customer themselves.
  2. JUUNIEK is not liable for errors or negligence, including those of its agents or employees, except in the event of fraud, intentional fault or gross negligence.
  3. Any liability of JUUNIEK is in any case limited to the purchase price of the product.
  4. JUUNIEK shall under no circumstances be liable for or obliged to compensate any immaterial, indirect or consequential damage of any kind whatsoever, such as, but not limited to, loss of profit, loss of turnover, loss of income or damage/claims of third parties.
  5. JUUNIEK is not liable for loss or damage arising from the use of a product.
  6. JUUNIEK is not liable for a disappointing end result arising from a photo of insufficient quality supplied by the customer (e.g. too dark, blurred or too low a resolution).

Art. 12 – Intellectual property

  1. The website, logos, photos, images, texts, works and other components of the website are protected by intellectual property rights held either by JUUNIEK or by suppliers or other rights holders.
  2. The full or partial reproduction, dissemination, sale, distribution, publication, adaptation, use for commercial purposes in any way whatsoever, electronic storage or use for unlawful purposes is prohibited without the prior written consent of JUUNIEK, its suppliers or other rights holders.

Art. 13 – Force majeure

  1. Each party is released by operation of law and is not obliged to perform any obligation towards the other party in the event of force majeure. Force majeure means the situation in which the performance of the contract by one of the parties is wholly or partly prevented, whether or not temporarily, by circumstances beyond the control of that party, even if this circumstance was already foreseeable at the time the contract was concluded. Without being exhaustive, the following are in any case considered force majeure: exhaustion of stock, delays in or failure of deliveries by a party’s suppliers, loss of goods or equipment as a result of accidents, machine breakdown, strike or lock-out, fire, riot, epidemic, flood, natural disaster, electrical, IT, internet or telecommunications failures, government decisions or interventions (including the refusal or cancellation of a permit or licence), fuel shortages, and errors or delays attributable to third parties. The party invoking force majeure is not obliged to prove the non-attributable and unforeseeable nature of the circumstance constituting force majeure.
  2. In the event of force majeure, the obligations of the party concerned are suspended. In such a case, the parties shall make every reasonable effort to limit the consequences of a force majeure situation. Should the force majeure last longer than two months, the other party is entitled to terminate the contract without judicial intervention, without the party invoking force majeure being liable to pay any compensation to the other party.

Art. 14 – Applicable law and competent court

  1. All contracts between JUUNIEK and its customers are governed exclusively by Belgian law. The application of international conventions, including the Vienna Sales Convention, is expressly excluded.
  2. Any dispute shall be submitted to the competent courts of Hasselt, Belgium. Consumers also retain the right to bring proceedings before the courts of their place of residence. For consumer disputes, you can also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.
